THE WHITENING CO — AFFILIATE PROGRAM TERMS & CONDITIONS

The Basic Company Ltd trading as The Whitening Co | Effective: 2026

 

These Terms and Conditions govern your participation in The Whitening Co Affiliate Program (the "Program"), operated by The Basic Company Ltd trading as The Whitening Co ("TWC", "we", "us"). By joining the Program, you ("Affiliate") agree to be bound by these terms in full.

 

1. ELIGIBILITY

To participate in the Program, you must:

• Be 18 years of age or older
• Hold a valid email address and, where applicable, a social media account in good standing
• Not be an employee, contractor, or immediate family member of TWC

TWC reserves the right to approve or decline any application at its sole discretion without being required to provide a reason.

 

2. HOW THE PROGRAM WORKS

Upon joining, you will be assigned a unique referral code. When a new customer completes a purchase using your code, you will earn a commission in accordance with Section 3.

Referred Customer Discount - Your code provides 15% off to the referred customer at checkout. This discount applies to first-time customers only, cannot be combined with any other offer or promotion, and applies to the order subtotal excluding shipping and taxes.

Tier Structure - Commissions are based on your cumulative number of successful referred orders:

• Smile Starter (1–3 referred orders): 8% commission
• Essential Insider (4–9 referred orders): 12% commission
• Platinum Partner (10+ referred orders): 15% commission

Tier upgrades are applied automatically. Commission is calculated on the sale value after the customer discount is applied, excluding shipping and taxes.

Welcome Gift

Upon your first successful referred sale, you will receive a complimentary TWC product. The specific product is at TWC's discretion and subject to availability. This gift has no cash value.

 

3. COMMISSION PAYOUTS

Commissions will be held for 35 days from the date of the referred sale to allow for any returns or refunds. If a referred order is cancelled or refunded within this period, the associated commission will be forfeited.

Payouts will be processed via the method selected in your affiliate dashboard. It is your responsibility to ensure your payout details are accurate and up to date. TWC accepts no liability for payments made to incorrect accounts where incorrect details have been provided.

Commissions have no minimum threshold unless otherwise stated in your dashboard.

 

4. PROHIBITED CONDUCT

As an Affiliate, you must not:

• Refer yourself, members of your household, or anyone using the same payment method or device as you
• Use paid search advertising that bids on TWC's brand name, trademarked terms, or any variation thereof
• Promote your referral code on discount or coupon aggregator websites
• Make false, misleading, or exaggerated claims about TWC products
• Offer cash back, additional incentives, or side payments to referred customers from your own commission
• Use spam, unsolicited messages, or any form of automated distribution to promote your code
• Engage in any conduct that could damage the reputation or brand of TWC

Breach of any of the above may result in immediate termination from the Program and forfeiture of any outstanding commissions.

 

5. FRAUD & ABUSE

TWC actively monitors for fraudulent activity. Any attempt to artificially inflate referral counts, manipulate tracking, or exploit the Program in bad faith will result in immediate removal from the Program, forfeiture of all accrued commissions, and may be reported to relevant authorities where applicable.

 

6. DISCLOSURE

You must clearly disclose your relationship with TWC whenever you promote your referral code, in accordance with applicable advertising standards and guidelines. This includes labelling posts, stories, or content with appropriate disclosure (e.g. #ad, #affiliate, or #sponsored) where required.

 

7. INTELLECTUAL PROPERTY

You may use TWC-provided brand assets (logos, images, copy) solely for the purpose of promoting the Program. You may not alter, modify, or misrepresent TWC's branding. All intellectual property remains the property of The Basic Company Ltd.

 

8. MODIFICATION & TERMINATION

TWC reserves the right to modify, suspend, or terminate the Program or these Terms at any time. Where reasonably practicable, we will provide notice of material changes. Your continued participation following any change constitutes acceptance of the updated terms.

TWC may terminate your participation in the Program at any time if you breach these Terms or for any other reason at its sole discretion. Upon termination, any commissions accrued but not yet paid out will be reviewed and paid where applicable, subject to the 45-day holding period.

 

9. LIABILITY

TWC's liability to Affiliates under this Program is limited to the payment of properly earned commissions. TWC accepts no liability for indirect, consequential, or incidental losses arising from participation in the Program.

 

10. GOVERNING LAW

These Terms are governed by the laws of New Zealand. Any disputes arising from or in connection with the Program will be subject to the exclusive jurisdiction of the New Zealand courts.
