Terms and Conditions

1. The Promotion

"Smile Week" (the Promotion) is a marketing promotion run by The Basic Company Ltd (NZBN 9429047024007), trading as The Whitening Co (TWC, we, us), of Auckland, New Zealand.

2. Promotion Period

The Promotion runs from 12:00am Monday 13 July 2026 to 11:59pm Sunday 19 July 2026 (NZT) (the Promotion Period). We may extend, shorten, or cancel the Promotion Period at our discretion, including if unforeseen circumstances affect our ability to run it fairly — see clause 12.

3. Eligibility

3.1 Online prizes (clauses 5–6) are open to residents of New Zealand and Australia aged 18 years or over.

3.2 The studio wheel (clause 7) requires attending our Ponsonby, Auckland studio in person during the Promotion Period.

3.3 Employees, contractors, and immediate family members of The Basic Company Ltd and any related company involved in operating this Promotion are not eligible to win a Big Prize (clause 6), but may still receive a standard prize under clause 5.

3.4 Entry is limited to genuine retail purchases made by consumers. Wholesale, trade, and account-based orders are not eligible.

3.5 By entering, you accept these Terms.

4. How to Enter

Online: Add your desired products to cart at thewhiteningco.com during the Promotion Period. Before you complete checkout, a digital wheel will appear on-screen showing your prize, which is automatically added to your cart. No minimum order value applies. Your prize (including a Big Wheel Spin entitlement, see clause 6) is only confirmed once your order is completed and paid for — if you don't complete checkout, no prize is granted and that outcome remains available to other customers. One (1) wheel spin per completed and paid order. Placing multiple orders gives multiple spins, subject to clause 6.4 and clause 12.6.

In-Studio: Book and attend a whitening treatment at our Ponsonby studio during the Promotion Period. Ask your practitioner for a spin of the studio wheel. One (1) spin per treatment booking. The studio wheel does not include Big Prizes (clause 7) and is separate from the online mechanic.

5. Online Wheel Prizes

Before you complete checkout, a digital wheel will appear on-screen showing your prize, which is automatically added to your cart. Every completed and paid online order during the Promotion Period wins a prize from the pool below.

Physical Online Wheel Prizes ship together with your order as part of normal TWC dispatch.

6. Big Prizes

6.1 Landing on "Big Wheel Spin" (clause 5) entitles you to a spin of our physical Big Wheel in-studio, which determines which of the following ten (10) Big Prizes you receive. There are ten (10) Big Prizes available in total across the entire Promotion Period, for online orders only:

Values shown reflect TWC's purchase price incl. GST and are provided as a guide only.

6.2 Once all ten (10) Big Prizes have been won, "Big Wheel Spin" will no longer appear as a possible outcome on the online wheel for the remainder of the Promotion Period, regardless of order volume. All further qualifying orders will win from the remaining Online Wheel Prizes pool (clause 5).

6.3 Where an order wins "Big Wheel Spin," we will spin our physical Big Wheel in-studio to confirm the specific Big Prize won. This is a separate step from the online wheel and does not happen instantly — winners will be contacted using the details provided at checkout once their Big Prize has been confirmed. This may be filmed and shared on TWC's social and marketing channels.

6.4 Limit of one (1) Big Wheel Spin / Big Prize per customer (by name, email address, and delivery address) across the entire Promotion Period. Where a customer would otherwise win a second "Big Wheel Spin," that order will instead receive a different prize from the Online Wheel Prizes pool.

6.5 If a qualifying order is subsequently cancelled, refunded, or returned in full, we reserve the right to void the associated Big Wheel Spin entitlement or Big Prize and, where the prize has already been dispatched or paid, to request its return or repayment.

7. Studio Prizes

The studio wheel is available in-studio to customers attending a whitening treatment during the Promotion Period, at no extra cost. Prizes:

• $30 off your current booking
• Pack of Strips
• Confidence Package
• Pack of Straws

Studio prizes have no cash value, are not transferable, and must be redeemed at the time of your visit unless otherwise agreed with your practitioner.

8. Winner Notification and Prize Delivery

8.1 Online winners will be notified using the email address or phone number provided at checkout. We'll make reasonable efforts to contact winners but take no responsibility for prizes that go unclaimed due to incorrect or outdated contact details provided by the entrant.

8.2 Big Prizes must be claimed within 30 days of notification. Unclaimed Big Prizes may be forfeited and, at our discretion, awarded to another eligible entrant or otherwise dealt with.

8.3 Physical Big Prizes will be delivered to the shipping address provided on the qualifying order no later than 30 days after the Promotion Period ends (by 18 August 2026), at no cost to the winner. We are not responsible for delays caused by couriers, customs processing for Australian deliveries, or incorrect address details supplied by the entrant.

8.4 TWC Vouchers ($50 TWC Voucher and Free Studio Whiten Voucher, per clause 5) are valid for 1 year from issue, redeemable in-studio only, not exchangeable for cash, and subject to appointment availability.

8.5 Where a Big Prize includes goods manufactured by a third party (Apple, Sony, Dyson, JBL, Ultimate Ears, Ninja), any manufacturer's warranty applies directly between the winner and the manufacturer. TWC is not responsible for the performance, quality, or fitness for purpose of third-party goods beyond what applicable consumer law requires.

8.6 The HBO Max Annual Subscription prize is awarded as a cash payment of $159.99, paid via bank transfer to the winner's nominated account within the timeframe in clause 8.3, in lieu of physical delivery or a subscription sign-up on the winner's behalf.

9. Substitution

We reserve the right to substitute any prize (in whole or in part) for a prize of equal or greater value, including where a listed prize becomes unavailable, without notice.

10. Photography and Video

Where a Big Prize spin is filmed in-studio, footage of that spin may be used across TWC's website, social media, and marketing without further notice or compensation. If a winner is separately asked to appear in or be named in any related content (e.g. an unboxing or announcement post), that will require their specific consent, separate from these Terms.

11. Privacy

Information collected as part of this Promotion (name, contact details, delivery address, order details) will be handled in accordance with TWC's Privacy Policy (https://whiteningco.nz/pages/general-faqs) and used only for the purposes of running and fulfilling this Promotion, unless you've separately opted in to marketing communications.

12. General Conditions

12.1 We reserve the right to amend these Terms, or to suspend, extend, or cancel the Promotion, at any time, including where we reasonably believe fraud, technical failure, or any other factor beyond our control has compromised the fair running of the Promotion.

12.2 To the maximum extent permitted by law, TWC excludes liability for any loss or damage (including indirect or consequential loss) arising from participation in this Promotion or from a prize, except where such liability cannot be excluded under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, the Australian Consumer Law, or other applicable law.

12.3 This Promotion is in no way sponsored, endorsed, administered by, or associated with Meta, Facebook, or Instagram.

12.4 These Terms are governed by New Zealand law.

12.6 We may take reasonable measures to detect and prevent abuse of the wheel mechanics (online or in-studio), and reserve the right to void any prize, Big Wheel Spin entitlement, or Big Prize obtained through fraudulent, abusive, or manipulative conduct, including repeatedly triggering and abandoning entries before completing a purchase.
